AMENDMENT TO THE GENERAL RENTAL CONDITIONS FOR RENTAL VEHICLES

Between the undersigned Hertz SALVA and the customer are set below the conditions (in addition to the General rental conditions which remain applicable) according to which the customer agrees to rent a vehicle in self- service:

1. BOOKING

Booking will be made either by phone by contacting the Hertz self-serve customer service, either via the Hertz self-serve online platform.

2. CONTRACT

By recovering the rental badge, you confirm that you have read and accept the rental terms and conditions. You also agree that an authorization request of the rental amount is carried out with your bank and that your credit card is charged for this amount at the end of the rental, and for any amount due to a rental overdue, extension, and/or to a non-compliance with the rental terms and conditions and insurance.

3. BOOKING EXTENSION/CANCELLATION/CHANGE

3.1 Booking extension

Each rental extension must be subjected to a prior verification of the availability of the vehicle. Extension can be done either by phone by contacting the Hertz self-serve customer service, either via the Hertz self- serve online platform.

3.2 Booking cancellation

Cancellation is possible and free of charge if it is carried out at least 30 minutes before the vehicle scheduled departure.

It can be done via the online platform by connecting into your account, or by telephone by contacting the Hertz self-serve customer service. Passed the 30 minutes delay cancellation must be made by phone by contacting the Hertz self-serve customer service. In this case, cancellation fees will be charged.

IN SELF-SERVICE

3.3 Booking change

Changing your reservation is possible by calling Hertz self-serve customer service.

Depending on the delay, fees can be charged and rental rates may be different.

4. PRICES/RATES

The price advertised during your booking validation is an estimate that assumes you return the vehicle and all its equipment intact at the given place, dates and time, and that you comply with the rental general terms and conditions.

If any of these assumptions proves to be incorrect, additional fees may be summoned.

5. INCLUSIONS/EXCLUSIONSIONS

The price includes fuel, unlimited mileage, CDW insurances (Collision), TP (theft, attempted theft), PI (carried passengers) as well as STF insurance (CDW and TP total franchise deletion in the event of a collision, theft and attempted theft) if rental terms and conditions and legal regulations are fully respected.

Warning: STF insurance does not cover the upper part above the vehicle's doors, the lower part below the doors and the tarp, tyres and the loss of key and badge.

6. PAYMENT

The total amount of the rental and of possible fees will be charged on the credit card registered when creating your account at the end of the rental.

7. INVOICE

Your invoice will be sent by email at the end of your rental and after your payment is validated.


Additional information about the RENTAL & INSURANCE GENERAL CONDITIONS in GUADELOUPE-MARTINIQUE- GUYANE

1. NATURE OF THE CONTRACT

Your use of our vehicle is subject to the rights and obligations under the rental agreement.

You cannot reassign these rights and obligations. You acknowledge that we own the vehicle and that any attempt to transfer or sublet the vehicle by anyone other than us would be void. You are only entitled to use the vehicle in accordance with the terms and conditions of the rental agreement.

2. AUTHORISED DRIVER OF THE VEHICLE

2.1 The vehicle can only be driven by you or any other person who received our prior approval and whose name has been registered in the rental agreement. However, the main driver of the vehicle must be the payer and the rental guarantor except in the case of rental made by account consignors. You agree to present the original copy of your driving license valid for at least one year, accompanied with an international driving permit which is mandatory for all countries outside the European union and whose licence would not be written in Roman alphabet and not to let the vehicle be driven by any person, including yourself:

2.1.1 who do not have the minimum age required by Hertz or not hold a valid driving license, depending on the category of vehicle concerned or of any request to us;

2.1.2 who is lying in a state of excessive fatigue or under the influence of alcohol, drugs, medication or any other legal or illegal substance altering their faculties or their ability to react.

3. QUOTATION

Rental rates and fleet vary greatly depending on the place and date of rental and change very frequently. A quotation is given only as an indication of the rates in force and does not create any legal rights. No guarantee as to the availability of the vehicle or the continued applicability of rates can be given.

4. BOOKING

A ' booking ' car rental is a note in our records according to which you expressed the desire and intention to rent a vehicle of a particular class at the place, date and time specified (the place, date and time of "departure") according to the terms and conditions and subject to their rules and restrictions. During the bookings, departure and return times are always given in local time at their respective places of departure and return.

Hertz accepts bookings only for one category of vehicles and not for vehicle brands, age and specific models or with characteristics that are not common to other vehicles in a particular category.

If Hertz allows you to make a booking, you accept all the ensuing legal obligations in detail below as well as the practical and non-legal implications of such a booking.

When you make a booking, Hertz will give you an estimate of the total to be paid for the rental. Such a total is generally determined on the basis of information received at the time of reservation and without regard of the products and services offered as options.

4.1 Prepaid Rentals

When you enter into a prepaid rental transaction, you make a confirmed booking with Hertz to rent a vehicle of a particular category at the place, date and time of departure specified knowing that the vehicle must be returned to the place, date and time of return specified, and at the same time you pay the total rental costs indicated at the time of booking using a debit card, a credit card charged shortly after booking.

4.2 Booking guarantee

During the agency opening hours we will maintain your booking up to two (2) hours from the time pick-up of the vehicle is planned. In an airport agency delay is two (2) hours after aircraft has landed (if flight details were given during booking). Outside of these defined delays, the booked vehicle may be made available to other customers. If you show up after these delays, Hertz will do its best to provide you with a vehicle, but will not be able to guarantee you of its availability.

In an airport agency, outside of the agency opening hours, delay is of 2 hours after landing from a long haul aircraft and of one hour after landing from a short or medium-haul aircraft.

As described below under "Conditions beyond Hertz's control ("Force majeure")" if, as a result of events or conditions beyond our control, it is impossible to carry out the obligations incumbent upon us, we can cancel the pre-paid rental transaction in which case we will refund, without any deduction the rental pre-payment that you have paid.

In addition, as described below under "Conditions beyond the customer's control" if, as a result of events or conditions beyond your control, it is difficult to carry out the obligations incumbent upon you, you will be excused upon receipt of your notice informing us of such events or conditions, and we will refund without deduction the rental pre-payment that you have paid.

4.3 Specific vehicle bookings

Hertz accepts bookings for vehicles classified as "specific" (requiring an availability enquiry towards our booking centre) with transactions defined as pre-paid (see conditions of pre-paid rentals).

4.4 Conditions beyond Hertz's control ("Force Majeure")

If we are unable to proceed any of the obligations incumbent upon us at the place, date and time of departure specified due to events or conditions beyond our control, including but not limited to acts of government, floods, fires or other natural disasters, unusually severe weather conditions (including wind or rain storms), epidemics, natural calamities, wars, terrorist acts, riots, insurgency, rebellion, state of national emergency, strikes or other industrial disputes, breakdown of services utilities, failures or disruptions of processing or data transmission, then in case of a pre-paid booking the latter will be cancelled and will be reimbursed quickly, without deduction of flat-rate damages.

4.5 Conditions beyond the customer's control

If you are unable to proceed any of the obligations incumbent upon you, above titled "pre-paid booking" to the place, date and time of departure specified due to events or general conditions beyond your control, including but not limited to acts of government, floods, fires or other natural disasters, unusually severe weather conditions (including wind and rain storms), epidemics, natural calamities, wars, acts of terrorism, riots, insurgency, rebellion, state of national emergency, strikes or other industrial disputes, failures or disruptions of processing or data transmission, then in case of a pre-paid booking the latter will be cancelled and will be reimbursed quickly, without deduction of flat-rate damages.

Please note, however, that events and conditions that are beyond your control, but which are not of a general nature, including, but not limited to your health and that of the passenger accompanying you, will not prevent you from fulfilling the obligations incumbent upon you in the case of a prepaid rental transaction.

To protect yourself from unforeseen events and conditions specific to your person or the passengers accompanying you, you may need to consider subscribing to a travel insurance or other similar measures.

4.6 Non-presentation of the customer ("No Show")

In case of non-presentation of the customer within the authorised delay, "no show" fees will be charged.

No fee is charged if the customer informs of its cancellation or change at least one hour before the vehicle's pick-up.

5. PICK-UP/DELIVERY/RETURN/EXTENSION

5.1 The vehicle will be given to you in a good working condition, and with all the necessary documents, equipment and accessories.

You agree to return the vehicle in the same condition as when picked-up, apart from normal wear and tear on the vehicle, and with the same documents, equipment and accessories, at the place, date and time specified in the rental agreement.

5.2 We will check the vehicle's condition at the beginning of the rental and upon return of the vehicle. A Hertz representative will establish a record of all damages found by mutual agreement. You acknowledge that you will be held responsible for any loss or damage suffered by the vehicle, its documents, equipment or accessories during the time of the rental.

5.3 The vehicle must be returned to the Hertz Agency agreed between the parties, during the concerned agency working hours. Any return outside of these hours will be carried out in accordance with the procedure in force in this agency. In this case, the vehicle will remain under your sole responsibility until the time of the agency's reopening. In the event of abandonment of the vehicle, you will be responsible for the vehicle until we are able to pick it up.

5.4 In the event that we allow you to return the vehicle in a rental agency other than Hertz, or if we agree to travel to recover it, you will be fully responsible for the vehicle until we have picked it up.

5.5 Our rental fees are calculated per period of 24 hours from the beginning of the rental. Any duration overdue (hours/days) initially foreseen in the contract shall be the subject of a prior agreement of Hertz. Any extension leads to the mandatory signature of a rental amendment. In the event of non-return or non-delivery of the vehicle at the agreed place, and at the latest time specified in the rental agreement, you will be charged a rental day at the daily rate applicable, as well as the fees corresponding to the options chosen for each full day or commenced day of lateness. This supplement applies upon reserve of any extension of the return delay (or "grace period") granted under an agreement concluded beforehand with us, or our current policy (for more details, please contact the rental agency). * The grace period is of 29 minutes. In the case of return in a different place from the one initially planned, additional fees will be charged.

In the case of early return a new rate calculation will be automatically done and will result in penalties. In case of non-agreement or non-compliance of the agreed return dates, you will be exposed to the consequences of a complaint for embezzlement and breach of trust, to all measures that will be taken from public authorities to retrieve the vehicle as well as the withdrawal of all insurances making you responsible for the theft and/or any damage suffered by the vehicle at the amount of the market value of the vehicle.

5.6 We may charge you an additional amount if, in addition to the damage associated with normal tear and wear, the vehicle requires more than a normal cleaning after his return in order to put it back in the state it was prior to his location, what you hereby accept.

5.7 If you wish to extend your rental beyond the period originally defined in the contract, you must present yourself in one of our agencies and pay the fare supplement corresponding to this extension. The rental party reserves the right to refuse the contract extension without compensation for the customer, with an obligation for this one to return the vehicle immediately. The rental party reserves the right to terminate early, immediately and fully their right to lease if you do not meet one of the essential obligations of the contract, in particular the conditions of use of the vehicle, paying the rent or the return conditions.

6. YOUR LIABILITY IN CASE OF DAMAGE OR LOSS

6.1 Under the sole reserve of the possible franchises related to your acceptance of one or the other of the options given in paragraph 4.2 above, you will be liable to us for any prejudice and all costs incurred by us in case of loss, damage or theft of the vehicle, its equipment or its accessories for the duration of the rental. Your responsibility may include cost of repairs, loss of value of the vehicle, loss of rental income, cost of towing and storing of the vehicle as well as administration fees incurred by Hertz in relation to the management of any claim relating to damages to the vehicle, unless the damage is caused by us or if it is determined by a third party or its insurers that this damage is caused by the third party. You will not be required to pay any fees or additional amount in case of loss or damage resulting directly from a fault that is due to us or from a violation of our part of the terms of the contract.

6.2 Provided that you comply with all the terms of this rental agreement, and if the loss, damage or theft are not intentional, or a result of a serious offence committed by you or by a licensed driver, or due to any non-authorized driver, your liability may be subject to the following limitations:

6.2.1 If you agree to purchase the option : warranty against theft (TP) and pay the daily fee, the amount of your liability in case of loss or damage to the vehicle, its equipment or its accessories for theft, attempted theft or vandalism, will be limited to the non-negotiable franchise indicated in the rental agreement;

6.2.2 If you agree to purchase the option: partial suppression of the Collision franchise (CDW) and pay the daily fee, the amount of your liability in case of loss or damage to the vehicle, its equipment or its accessories not resulting from theft, attempted theft or vandalism will be limited, for each loss or damage caused by a separate event to the franchise specified in the rental contract and

6.2.3 If you agree to purchase the option: total suppression of the collision franchise (Super CDW) and the conditions attached thereto and pay the daily fee, you will be exempt from any liability in case of loss or damage to the vehicle, its equipment or its accessories not resulting from theft, attempted theft or vandalism.

6.2.4 If you agree to purchase the option: total franchise suppression (STF) and the conditions attached thereto and pay the daily fee, you will be exempt from any liability in the event of theft, attempted theft or vandalism, and in case of loss or damage to the vehicle, its equipment or its accessories. If you don't subscribe to any of the optional guarantees above, your responsibility will be committed to the maximum franchise specified on your rental agreement.

6.3 You are fully responsible for any damage resulting from a misjudgment of the height of the vehicle or from a collision with objects placed or suspended on top as well as all shocks and damages to the low and high parts of the vehicle. No optional guarantee will rule out this responsibility. You are fully responsible for the tires, no optional guarantee will rule out this responsibility.

6.4 Customers under 25 or over 65 years old cannot benefit from the SCDW and STF guarantees.

7. PROHIBITED USE OF THE VEHICLE

7.1 You are allowed to drive the vehicle in accordance with the conditions set out in the present paragraphs 2 and 5 above, in a good household manner. In case of non-compliance with these conditions, you will be required to compensate us for any liability and for any loss, damages or expenses that we could suffer or be exposed to because of your failure. You may also lose the benefit of any waivers or insurance that you may have chosen. We reserve the right to retrieve the vehicle at any time, and at your expense, in case of non-compliance on your part of the terms of the contract.

7.2 you must take care of the vehicle, make sure it is locked, safe and parked in a safe place when you do not use it, and use any security device supplied with the vehicle. You must remove and keep in a safe place any device and/or removable radio front when the vehicle is not occupied. You must use the safety belts, car seats and any other protections for children.

7.3 You must use the proper fuel type and check oil level and other liquids, beyond 1000 km for cars and 500 km for commercial cars, and make the necessary upgrades in case of need. You must contact us at the number shown in the keys folder for any anomaly resulting from an accident or mechanical failure. The vehicle will not be subject to any intervention or repair without our express prior permission.

7.4 You may not use the vehicle or allow anyone to use it:

7.4.1 for paid transportation of passengers;

7.4.2 for paid transportation of goods (except in the case of trucks and commercial vehicles);

7.4.3 to tow or push any vehicle, trailer or any other object (without our express permission);

7.4.4 outside the roadways or road adapted to the vehicle;

7.4.5 when the vehicle is overloaded or when boarded loads are not properly attached.

7.4.6 for transporting objects or substances which, because of their state or their odor can damage the vehicle and/or delay the possibility of renting the vehicle again.

7.4.7 to participate in motor races, rallies, trials or any other competitions;

7.4.8 in breach of the Highway Code or other regulations;

7.4.9 for all illicit purposes;

7.4.10 for all sub rents;

7.4.11 to drive or be driven in forbidden public areas including airports strips, airports service roads and other similar areas;

7.4.12 for learning driving;

7.4.13 in violation of any of the conditions set out in paragraph 2 above concerning the driver.

7.5 Hertz vehicles may not under any circumstances leave the department or dependency where they were rented. Beyond these territorial boundaries, insurance of the vehicle, protection complements as well as the liability amounts in case of accident or theft are no longer valid. In case of an accident or theft you will be responsible within the limits of the market value of the vehicle.

8. RENTAL PAYMENT

8.1 We accept for payment and deposit main credit cards, Hertz accredited cards and OTTO vouchers. The main driver of the vehicle must be the payer and the guarantee of the contract except in the case of rentals made by account consignors.

8.2 At the time of the vehicle pick-up you must make a deposit. You authorize Hertz to keep the amount of the deposit paid (including electronically direct debits) in payment of the amounts owed by you under the rental obligation but also for any damage or loss as defined in articles 6- 7-11-12-13-14-15-17 or costs related to the non-return of the vehicle.

8.3 In the event of non-payment of all or part of the amount that we are owed under this rental agreement within the time indicated on your invoice, we reserve the right to apply overdue interests in addition to the amounts due, at the rate of the interbank credit base for a period of one month plus 3%.

9. ANTICIPATED OR PRE-PAID PAYMENT TERMS

Pre-paid refers to any contract which has been subjected to a payment at the time of booking.

9.1 Booking change

Any changes made on an online booking or through our customer advisors will result in a new rate calculation depending on availability and prices at the time of change. The adjustment can be an increase or a reduction of the proposed rate when booking.

It applies to changes in the following points:
-Agency of return,
-Pick-up time and date,
-Return time and date,
-Category of the vehicle,
-Flight number & name of the airline,
-GPS,
-Child seats,
-All other options.

The name of the main driver and the pick-up place of the vehicle cannot be changed. If you wish to change this information, you will need to cancel your booking (please see below in "Cancellation") and make a new booking.

You will need to enter a valid credit card number at the end of the change of a prepaid booking. The credit card number MUST be the one used when initial booking was done. If you want to change your credit card, you will need to cancel the original booking (please see below in "Cancellation") and make a new booking.

If the agency does not have a vehicle at the desired date, you will receive the message "no vehicle available for this date or period". Then try to change the date or place of pick-up.

Discounts: you can add a discount code also called CDP to a booking, however the CDP being related to a negotiated rate, it is not compatible with the prepaid fare. You can cancel your original booking (please see below in "Cancellation") and make a new booking by adding your code.

9.2 CANCELLATION

9.2.1-Hertz allows you to cancel a prepaid reservation:
a. online in the section "change or cancel your booking".
b. by calling our customer service advisors.

9.2.2-Hertz will make a full refund of your prepaid reservation:
a. If the cancellation of the booking takes place within 7 days of the date you made the original reservation,
b. With some administrative fees if cancellation takes place seven days after the date you made the original reservation.

9.2.3-any refund will be made by cheque to the order of the payer of the rental.

9.3 CANCELLED RENTAL /NO SHOW

If you do not cancel your booking before departure time and don't show up to pick up the vehicle on the date of departure, or if you do not meet the conditions required to pick up (see above), we reserve the right to charge a cancellation/no show fee to cover our administrative costs and compensate for the shortfall of the vehicle you booked that could have been rented.

9.4 NO-SHOW FEE

If you do not show up to pick up the vehicle within 2 hours of the date and time agreed or within 2 hours after the arrival of the flight (if the arrival time was given) in the case of an agency in an airport, Hertz reserves the right to charge a no-show fee. These fees will be used to compensate Hertz for the shortfall, the expenses incurred when booking and preparing of the vehicle.

9.5 PAYMENT METHODS

For prepayments, it is essential that the person in whose name the booking was made is the holder of the credit card. The person who prepaid the rental must be one for which the vehicle is rented.

For identification and security reasons, you must submit to the Hertz counter the same credit card that was used for paying the deposit and the fares. If the card used for the booking has expired, has been lost or stolen, you will need to present the replacement card in the name of the same holder.

10. DISCOUNTS and PRICE AGREEMENTS

Any price discount linked to a CDP or an agreement will be subject to presentation of evidence at the counter (e.g.: business card, voucher…).
Otherwise, you agree that the in force rate will be applied. The offers are not cumulative.

11. FEES

11.1 The fees mentioned in the rental contract are related to your use of the vehicle such as agreed between us at the beginning of the rental and include the basic rental fee; options and services that you have chosen and the applicable taxes at the rate in force.

11.2 Rental costs are established for a minimum of one rental day (the period of 24 hours starting from the beginning of the rental) and include mandatory civil liability insurance costs. A young driver supplement is asked whether you or any additional driver registered in the contract are under 25.

11.3 Your use of the vehicle during the rental may result in additional costs, including the costs associated with loss or damage to the vehicle, the fees for claims management, delivery costs, agencies costs in the airport and port areas, recovery costs of the vehicle, fuel costs if the tank is not full when the vehicle is returned, late return costs, costs resulted from any additional driver, or young driver, extra cleaning costs, as well as all tolls charges, fines or costs resulting from breaches of the traffic or parking regulations during the duration of the contract (including administrative fees of a reasonable amount as provided for in paragraph 17.2).

11.4 All fees are calculated in accordance with our current rates and are subject to a final calculation after the rental.

12. FUEL COSTS

The rental vehicle will be delivered with a full tank of fuel (unless exception).
If you do not return the vehicle with the same fuel level than the one at the time of departure, we will charge you "fuel services costs" in addition to the price per litre of fuel consumed.

For rentals of less than 50 km on the meter, you must present a valid proof of the update of the level of fuel. Otherwise, Hertz will evaluate the consumption by multiplying the mileage covered by the consumption index of the vehicle category and the price per liter.
[Consumption index = (number of average litres /100 consumption = Mileage covered X consumption index X price per litre of fuel)].

13. DAMAGE to PROPERTY

13.1 We will not be liable to you or to any other driver or passenger for loss or damage to property left in the vehicle, either during or after the rental period, unless the loss or damage is due to a fault or a breach of this rental agreement which we would be accountable for. You solely assume all risks related to these assets.

13.2 The complementary insurance (P.I.) is a guarantee that provides certain benefits to the driver and passengers of the vehicle in the event of accidental death, injury.

14. CIVIL LIABILITY INSURANCE

14.1 We are legally required to provide civil liability coverage. It is included in the rental fee.

14.2 Our automobile civil liability insurance policy is consistent with all the legal provisions and protect us, you and any authorized driver, against all actions driven by third parties in the event of death or injury or damage suffered by third parties as a result of the use of the vehicle.

14.3 In the event of death or injury or damage suffered by third parties as a result of any use of the vehicle by yourself or by any authorized driver in violation of the terms and conditions of this rental agreement, you agree to reimburse us any compensation that we would be required to pay, if any, (i) to insurers in respect of the amounts paid to a third party for your account, and/or (ii) to any third party.

15. ACCIDENTS, THEFT AND VANDALISM

15.1 You are required, as much as possible, to immediately report to the police any traffic accident involving the vehicle, and to report to the police any loss, damage or theft involving the vehicle within a period of 48 hours following the occurrence or discovery of the incident. You are required to report to us any claim within 2 days after its discovery.

15.2 In the event of an accident, you agree not to recognize any responsibility, remove anyone from its responsibility, resolve any complaint or accept any liability waiver, and will have to pick up the names and addresses of everyone involved, including the witnesses.

15.3 Any accident or theft will need to be reported with the delivery of a report or a complaint at the vehicle is returned. In the event of theft, you will need to give us back the keys to the vehicle, as well as the remote control of the anti-theft system, if necessary. In the event of non-compliance with the provisions of this section 15, any optional coverage subscribed to reduce or eliminate your responsibility, as in the case of guarantees CDW or Super CDW (in case of an accident) or TP and STF (in case of theft), will be void.

15.4 You agree to cooperate with us and with our insurers in any investigation or judicial proceedings resulting from any loss or damage sustained by the vehicle.

16. LIMITATIONS OF LIABILITY

16.1 Subject to the provisions of paragraph 16.2, we will not be liable to you or to any third party for any loss or damage resulting from the rental, except only in the case of negligence or gross negligence from our part, or any other failure from our part in terms of this rental agreement. We cannot be held liable for indirect or unpredictable losses or damage, including loss of profit or opportunity.

16.2 None of the provisions of paragraph 16.2 shall exclude or limit our liability for death or personal injury resulting from our actions or omissions, nor any other liability which the law provides that it cannot be ruled out.

17. TOLLS, PARKING TICKETS AND TRAFFIC VIOLATIONS

17.1 You are required to pay all tolls charges, as well as any fine and you are responsible for any violation of the Highway Code, parking regulations in parking lots, or to any other law or regulation, which occurred during the rental.

17.2 If we are required to treat any fines, charges or other costs you incurred and that would be claimed to us, we will charge you administrative fees, as part of our intervention, what you hereby accept.

18. PERSONAL DATA

18.1 When concluding this rental agreement, you agree that we proceed to storage and processing of your personal data in connection with this rental agreement and in our legitimate interest, including for the purposes of statistical analysis, bank checks and protecting our assets. As a result, in the event of a violation from your part of this rental agreement, your personal data may be disclosed or communicated to third parties, to the extent necessary for any recovery procedures or to protect our property from any damage.

18.2 You acknowledge that if you use a CDP (discount code) related to a company, we will need to communicate to the company the personal data related to you.

18.3 You have the right to access, correct or delete personal data about you in our possession.

19. INTERPRETATION

If any of the provisions of this rental agreement is recognized in full or in part, void, illegal or unenforceable under applicable law, that provision or the concerned part or the part will be deemed not to be a part of this rental agreement insofar as it is recognized void, illegal or unenforceable. However, the rest of the provisions of this contract will remain applicable and in full effect.

20. APPLICABLE LAW

All disputes that could not be settled amicably will be governed by the French law and you agree that these disputes are subject to the non-exclusive jurisdiction of the French courts. However, in the case of disputes with professionals, they will be subject to the exclusive jurisdiction of the commercial court of Pointe-à-Pitre.
